Supporting documents for the registration of the insurance and reinsurance intermediary in the special register

  1. For the registration in the special register, the insurance and reinsurance intermediary referred in cases (a) and (b) of paragraph 3 of article 19, shall submit to the competent chamber the following documents:

(a) Graduation certificate of high school or six-year school or equivalent school abroad.

(b) General criminal record certificate, searched for ex officio and renewed every two years by the competent chamber, indicating that person concerned has not been convicted of a crime against property or related to financial activities and in particular for usury, profiteering, fraud, embezzlement, bribery, fraudulent bankruptcy, extortion, theft, smuggling, forgery, misappropriation, lender fraud, issuing unsecured checks, money laundering, and setting up of a criminal organization.

(c) Certificate attesting that no application for bankruptcy and compulsory management has been lodged against him/her and that he/she has not been declared bankrupt or put into compulsory management, if he/she has been declared bankrupt, that he/she has been reinstated.

(d) Certificate attesting that he/she has not been deprived of subsidiary or subsidiary legal assistance.

(e) Certificate of professional indemnity insurance covering all the territory of the European Union or any other similar guarantee of professional liability resulting from professional negligence for at least one million two hundred fifty thousand six hundred eighteen (1,250,618) euro per claim and at least one million eight hundred seventy-five thousand nine hundred twenty-seven (1,875,927) euro in the aggregate per year for all claims, unless the insurance or reinsurance intermediary, other than the broker, furnishes a statement of the insurance undertaking in whose name he/she is acting or is authorized to act, indicating that the insurance undertaking in question has assumed full professional liability for his/her actions. The above amounts shall be adjusted, by decision of the supervisory authority, in the event of their revision by E.A.A.E.S. The maximum exemption amount from the insurance referred to in the first subparagraph, as provided in the contract, may not exceed eighteen thousand seven hundred sixty (18,760) euro.

(f) One or more certificates of professional knowledge provided, where appropriate, by the decision of the supervisory authority issued by the delegation referred to in paragraph 2 of article 20.

(g) Solemn declaration by the insurance or reinsurance intermediary with the following information:

(aa) the identity of the shareholders or partners, whether they are natural or legal persons, holding more than 10% in the intermediary, and the percentage of such holdings;

(bb) the identity of persons who have close links with the intermediary;

(cc) information that such holdings or close links do not impede the effective exercise of the supervisory authority’s functions.

 

  1. In addition to the above, the applicant, in order to register with the special registrar as an insurance agent coordinator, submits documents showing that for at least three (3) years he/she has either been registered as a natural person in the special registry in any category of insurance intermediation, or has been a member of the management or a member of the management body responsible for the activity of distributing insurance products, in an insurance or reinsurance intermediary or in an insurance or reinsurance undertaking in Greece or abroad, or having worked in an insurance or reinsurance brokerage firm or in an insurance or reinsurance undertaking in Greece or abroad as an employee directly involved in insurance brokerage activities. If the applicant has a domestic higher education institution (AEI) degree or equivalent of a foreign institution, it suffices to have had any of the capacities of the previous indent for two (2) years. If the person applying for registration as a coordinator has a postgraduate education of at least one (1) year in private insurance matters, it is sufficient that he/she has had any of the capacities of the first subparagraph for one (1) year.
  2. The documents referred to in cases a, b, c, d and f of paragraph 1 and those of paragraph 2 shall relate to:

(a) the natural person registered as individual business in the special register;

(b) the natural persons whose details are communicated to the competent chamber in accordance with paragraphs 5 and 6 of Article 19;

(c) employees of the insurance or reinsurance intermediary directly involved in the distribution of insurance and reinsurance products.

 

  1. In addition to the provisions of paragraph 3, the documents referred to in cases (c) and (e) of paragraph 1 shall apply to the natural or legal person applying for registration, and the documents referred to in paragraph (g) of paragraph 1 shall relate to the legal person applying for registration.
  2. By decision of the supervisory authority, published in the Government Gazette, the form, type and content of professional liability insurance of the case (e) referred to in paragraph 1 may be determined and the maximum exemption amount from the insurance cover of the same provision may be revised.

Supporting documents for the registration in the special register of the insurance intermediary who performs insurance intermediation as a secondary activity

  1. For registration in the special register, the insurance intermediary who carries out insurance mediation as a secondary activity shall submit to the competent chamber the following documents:

(a) High school or six-year school or equivalent school abroad graduation certificate;

(b) General criminal record certificate, searched for ex officio and renewed every two (2) years by the competent chamber, indicating that he/she has not been convicted of a crime against property or related to financial activities and in particular for usury, profiteering, fraud, embezzlement, bribery, fraudulent bankruptcy, extortion, theft, smuggling, forgery,misappropriation, lender fraud, issuing unsecured checks, money laundering, and setting up of a criminal organization;

(c) a certificate attesting that it has not been bankrupt or, if insolvent, that he has been restored;

(d) Certificate attesting that he/she has not been placed under privative or auxiliary judicial support;

(e) a statement of the insurance undertaking in whose name he/she is acting, or of which he/she is authorized to act, that the insurance undertaking in question has assumed full professional liability for the actions of the intermediary in respect of the promotions its products,

(f) the attestation referred to in paragraph 5 of article 20;

(g) Solemn declaration by the intermediary with the following information:

(aa) the identity of the shareholders or partners, whether they are natural or legal persons, holding more than 10% in the intermediary and the percentage of such holdings;

(bb) the identity of persons who have close links with the intermediary;

(cc) confirmation that such holdings or close links do not impede the effective exercise of the supervisory authority’s functions.

  1. The documents referred to in cases a, b, c, d and f of paragraph 1 shall relate to:

(a) the natural person registered as individual business;

(b) the natural person exercising the management of the legal person or, in the case of collective administration, the natural persons who are members of the administration and are responsible for the distribution activity of the legal person applying for registration; (c) the officials of the insurance intermediary exercising as a secondary activity of insurance intermediation, which are directly involved in the distribution activity of insurance and reinsurance products.

  1. In addition to the provisions of paragraph 2, the documents referred to in cases (c), (e) and (f) of paragraph 1 shall apply to the natural or legal person applying for registration, and the documents referred to in paragraph (g) of paragraph 1 shall relate to the legal person applying for registration.

Maintenance of registration in the special register and deletion

  1. In order to maintain their registration in the special register referred to in paragraph 1 article 19 hereof, insurance and reinsurance intermediaries and insurance intermediaries who carry out insurance intermediation as secondary activity shall submit to the competent chamber within the first quarter of each third year beginning on the 1st January of the year following that of their registration, the documents referred to in articles 21 and 22, except for those referred to in cases (a) and (f) of paragraph 1 of article 21 and cases (a) and (f) of paragraph 1 of article 22, with the following exceptions:

(a) the documents referred to in case (e) of paragraph 1 of article 21 and case (e) of paragraph 1 of article 22, shall be submitted within the first quarter of each year;

(b) the solemn declaration of case (g) of article 21 and case (g) of article 22, shall be submitted whenever a modification of the relevant data is made. In addition to the above, insurance and reinsurance intermediaries and insurance intermediaries who carry out insurance intermediation as a secondary activity shall submit to the competent chamber, within the same time limit, an attestation of the competent Tax Office that they have not declared interruption of the distribution of insurance and reinsurance products activity. Certificates, as the case may be, provided for by the decision of the supervisory authority, issued in accordance with paragraph 4 of article 20, shall be submitted within the first quarter of the year following that of the seminars, as a condition of maintaining the registration in the special register.

  1. In addition to the provisions of paragraph 1, the insurance and reinsurance broker shall submit to the competent chamber, within the first quarter of each third year, beginning the 1st of January of the year following that of his/her registration, the breakdown of its activities per insurance and reinsurance undertakings during the previous three (3) years.
  2. If the insurance or reinsurance intermediary or insurance intermediary carrying out insurance intermediation as a secondary activity, fails to comply with the requirements of paragraphs 1 and 2, and if the competent chamber finds that the requirements of articles 21 and 22 are not fulfilled, the chamber deletes, without delay, the natural or legal person from the special register and notifies to the supervisory authority a copy of the deletion decision within thirty (30) days of its issuance. The supervisory authority shall inform the host member-state of the intermediary of such deletion.

 

Supporting documents for the registration of a real estate broker

  1. APPLICATION
  2. ID or PASSPORT, in case of a Greek citizen or a citizen of a Member State of the European Union or of a Member State of E.E.A.
  3. PROOF OF STUDIES, grammatical competences:  Graduation certificate at least from a high school or equivalent school in Greece or abroad.  Foreign diplomas require a photocopy of the diploma certified by a lawyer and a translation by the Ministry of Foreign Affairs as well as an attestation of equivalence from the Ministry of Education.
  4. SOLEMN DECLARATION OF LAW 1599/86(attached at the bottom of the page).  The solemn declaration is signed by the person concerned himself/herself at the Chamber or presented by another person with the authenticity of his/her signature certified by the Police or by any Public, Municipal or Community Authority.
  5. FOR ALLIENS: Except for nationals of Member States of the European Union or EEA Member States, where it concerns a third-country national, a residence and work permit in Greece or a residence permit for independent economic activity.
